Welcome to HS-Markets Client Agreement
This Agreement governs your relationship with HS-Markets Limited for all trading activities, including Forex, CFDs, commodities, and other instruments. Please read this summary carefully before engaging in any transactions.
1. General Overview
- The Company is registered in Saint Lucia under IBC No. 2024-00604.
- This Agreement includes related policies: Privacy, Risk Disclosure, AML, etc.
- The Company does not accept clients from the U.S. and Vietnam.
2. Key Definitions & Platform Use
Defines terms such as Access Data, CFDs, Trading Platform, Margin, Equity, and more. Users agree to abide by the platform rules and acknowledge risks of trading instruments.
3. Account Opening & Due Diligence
Clients must complete KYC/AML checks and provide valid documentation. The Company reserves the right to reject or close accounts if criteria are not met.
4. Services Offered
Includes execution of CFD orders, safekeeping of assets, currency conversion, and related brokerage services.
5. Disclaimers & Responsibilities
HS-Markets provides execution-only services and does not offer investment or tax advice.
6. Costs and Charges
All applicable trading commissions, spreads, and fees are disclosed on the website or platform. Clients are responsible for taxes and transactional costs.
7. Communication & Notices
Written notices may be delivered via email, personal area, or platform. All communications may be recorded and used as evidence.
8–10. Confidentiality, Amendments & Termination
The Company handles personal data in accordance with its Privacy Policy. Agreement terms may change with prior notice. Clients or the Company may terminate the agreement with notice.
11–13. Default, Force Majeure & Liability
Defines client default events and Company’s rights. In force majeure events (e.g. war, outage), the Company may take emergency actions. Company liability is limited unless gross negligence occurs.
14–17. Representations, Risks, Law, Severability
Clients warrant the legality of their funds and confirm understanding of risks. Disputes fall under Saint Lucia jurisdiction. Invalid clauses do not affect the rest of the Agreement.
18–24. Miscellaneous Clauses
- Company may assign rights to third parties (e.g. in mergers).
- Client data may be shared with third parties as needed for compliance.
- Portfolio management and affiliate systems are governed by separate terms.
Client Funds and Account Terms (Part B)
Outlines how client funds are handled, including pooling in omnibus accounts and protection limits. The Company reserves rights for account blocking, netting, and lien in cases of risk or breach.
